Addon Terms of Service

These Terms of Service ("Terms") govern your subscription to and use of any paid ServiceM8 addons supplied by Over Geek (ABN 67 285 792 296) ("we", "us", "our"). By installing, enabling, or paying for an addon, you ("you", "your", "customer") agree to these Terms.

For free addons, only the sections relating to use, support, liability, privacy, and changes apply. Billing-related sections apply only to paid addons.

1. The Service

"Addon" means any ServiceM8 addon developed and supplied by Over Geek that you have installed or subscribed to via the ServiceM8 Add-On Store, a direct install link, or our website.

Addons run inside the ServiceM8 platform. Your access to ServiceM8 itself is governed by ServiceM8's own terms — these Terms only cover the Over Geek addon component.

2. Subscription & Billing

  1. Month-to-month. Paid addon subscriptions are billed on a recurring monthly basis. There is no fixed-term contract — your subscription continues each month until cancelled.
  2. Payment processing. Payments are processed through Stripe and/or via the ServiceM8 Add-On Store. You authorise recurring charges to your nominated payment method for the agreed monthly fee plus any applicable taxes (including GST where relevant).
  3. Pricing. Pricing is displayed at the point of subscription (either on our website or in the ServiceM8 Add-On Store) and may differ between regions based on ServiceM8's local pricing. We may change pricing from time to time; we will give you reasonable advance notice of any price increase, and you may cancel before the new price takes effect.
  4. Failed payments. If a payment fails, we may suspend or disable the addon until payment is successful. Repeated failures may result in cancellation of your subscription.
  5. Taxes. All prices are in the currency shown at checkout. Where GST or other taxes apply, they will be added at the point of sale.

3. Cancellation & Refunds

  1. How to cancel. You can cancel your subscription at any time directly from inside ServiceM8 by disabling the addon, or via the ServiceM8 Add-On Store. If you have trouble cancelling through the app, contact us at [email protected] and we will assist.
  2. End of billing period. Cancellation takes effect at the end of your current monthly billing period. You will retain access to the addon until that date.
  3. No refunds. We do not provide refunds for any unused portion of the current billing period. No partial-month refunds, pro-rata adjustments, or credits will be issued.
  4. Service termination. Once cancellation takes effect at the end of the billing period, the addon will stop functioning and access to associated features and data will be removed. You are responsible for exporting any data you wish to keep before that date.
  5. Statutory rights. Nothing in this section limits any rights you have under the Australian Consumer Law that cannot be excluded by agreement.

4. No Service Level Agreement (SLA)

Our addons are supplied on an "as is" and "as available" basis. We do not offer any service level agreement, uptime guarantee, response time commitment, or availability warranty. While we work hard to keep addons running smoothly, we do not guarantee uninterrupted, error-free, or always-available service.

Addons depend on the ServiceM8 platform, your internet connection, third-party APIs, and our own infrastructure. Outages, downtime, or issues outside our control will not automatically entitle you to a refund or credit.

Extended outages. In the case of a significant or extended outage that materially affects your use of the addon, we may, at our discretion, review and offer a credit or partial refund on a case-by-case basis. To request a review, contact us at [email protected] with details of the outage and the impact on your business. Any credit or refund issued under this clause is goodwill and does not constitute an admission of liability or create an ongoing SLA.

5. Support

Best-effort support is provided by email at [email protected]. We do not guarantee response times, but we aim to respond to support requests within a reasonable timeframe.

Support is limited to the addon itself — we cannot provide support for ServiceM8 core functionality, your ServiceM8 account configuration, or third-party integrations.

6. Acceptable Use

You agree not to:

  • Reverse-engineer, decompile, or attempt to extract source code from the addon
  • Resell, sublicense, or redistribute the addon to third parties
  • Use the addon in a way that breaches the ServiceM8 terms of service or any applicable law
  • Attempt to circumvent billing, licensing, or rate-limiting mechanisms
  • Use the addon to send spam, illegal content, or anything that could harm our infrastructure or other users

We reserve the right to suspend or terminate access for breaches of these Terms.

7. Data & Privacy

Use of our addons may involve processing data from your ServiceM8 account. How we handle that data is set out in our Addon Privacy Policy, which forms part of these Terms.

You retain ownership of your data. We act only as a data processor in respect of any ServiceM8 data accessed through the addon.

8. Intellectual Property

All intellectual property rights in the addons, including code, design, and documentation, remain the property of Over Geek. Your subscription grants you a non-exclusive, non-transferable licence to use the addon for your business operations within ServiceM8 for the duration of your subscription.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability to you under these Terms is limited to the fees you have paid us in the 1 month immediately preceding the event giving rise to the claim;
  • We are not liable for any indirect, incidental, consequential, or special damages, including loss of profits, loss of data, business interruption, or loss of goodwill;
  • We are not liable for any damages caused by issues with the ServiceM8 platform, third-party services, your internet connection, or events outside our reasonable control.

Nothing in these Terms excludes or limits any rights you have under the Australian Consumer Law that cannot be excluded by agreement.

10. Changes to These Terms

We may update these Terms from time to time. The current version will always be available at overgeek.com.au/terms-of-service/. Material changes will be notified by email or via a notice in the addon. Continued use of the addon after changes take effect constitutes acceptance of the updated Terms.

11. Termination by Us

We may suspend or terminate your access to the addon if:

  • Payment fails and is not corrected within a reasonable time;
  • You breach these Terms;
  • We discontinue the addon (in which case we will provide reasonable notice and pro-rata refund if you have prepaid for any future period beyond the current billing month).

12. Governing Law

These Terms are governed by the laws of Western Australia, Australia. Any disputes will be handled in the courts of Western Australia, unless required otherwise by law.
